Trademark Law in Michigan

Trademarks are used to claim exclusive rights to products or services. Trademarks can be owned, but also licensed. For example, if someone trademarks a cartoon, he or she could sell a license to a cereal company to use the cartoon on the box or in other advertising materials. In Michigan and elsewhere in the United States, common law trademarks are also recognized, but it is in the interest of individuals and corporations to own trademarks due to the additional protection they are afforded in the event someone infringes upon them.

Copyright Law in Michigan

A copyright gives the creator of an original work, such as a book, a magazine article, a song's music or lyrics, exclusive rights to his or her work. The concept behind copyright is that the creator of the work should have an exclusive window to profit from his or her efforts and creativity. Copyrights also provide the copyright holder with the right to choose how his or her work may be adapted for other purposes (such as music being used in a feature film or advertisement), who may perform his or her work and who may financially benefit from it. Like other forms of intellectual property, litigation can be pursued by copyright holders if their copyright has been infringed upon.
