Michigan's Water Use Framework & Where Disputes Arise
Michigan regulates large-quantity water withdrawals through Part 327 of the Natural Resources and Environmental Protection Act (NREPA). Any well or water withdrawal system capable of drawing 100,000 or more gallons per day — the equivalent of 70 gallons per minute — qualifies as a high-capacity well and must be registered with the state, with annual water use reported to EGLE or the Michigan Department of Agriculture and Rural Development (MDARP) depending on the use type.
Before a new high-capacity withdrawal can be registered, it must pass through EGLE's Water Withdrawal Assessment Tool (WWAT). The tool evaluates whether the proposed withdrawal is likely to cause an adverse resource impact to nearby streams or water bodies. If the tool flags the proposal, the applicant must undergo a site-specific review before the registration can proceed. Withdrawals above two million gallons per day require a full state permit rather than registration.
Most water usage disputes in Michigan trace back to this framework.
